Scope of the Terms
Terms and Conditions describes the terms of service for use of CareBynd’s application and all products and services rendered through the end user engagement via CareBynd. These terms of service are only pertinent to the products, features and services exclusivly offered by CareBynd to its subscribers. All services provided to CareBynd users through third parties such as other product or service providers, websites or applications will be governed by the terms and conditions of the third party groups rendering the products or services.

Please read the terms and conditions before using our services. These terms and conditions describe the terms on which you may access our products and services. CareBynd provides its products and services through its web and mobile based application that can be located at https://app.carebynd.com through the web and “carebynd” app on the smart mobile devices including smart mobile phones. Collectively any product or service including future services and features not currently available now are subject to the these terms and conditions, these are intended as end users terms of service to use CareBynd’s application. We reserve the the right at our sole discretion to modify portions or entirity of these terms of service at any time, In an event we modify portions or entirity of this terms and conditions, we will notify you through posting it on the application and notifying you of the changes to your terms and conditions via email registered with us to use the application. Any changes become effective 15 calendar days after being posted except for changes addressing new features of the service or changes made for legal reasons will be effective immediately. Your continued use of service after the date of any changes being effective will constitute your consent for the revised terms of service.

At CareBynd we are committed to protecting and preserving the privacy of our users. Our application’s privacy policy both through use of the application via website and smartphone has been provided by a legal resource and reviewed and approved by their solicitors.
This Privacy Policy explains how any personal data that you provide to us, or that we collect from you whilst you use our application.
This Policy will be updated from time to time so please do review this Policy regularly.
Information We Collect
In running and maintaining our application either through use of website or through smartphone we may collect and process the following data related to you or other family members or friends on your account,
- Information about your use of our site or smart phone application including details of your Patient Medical Records, self-reported data, pages viewed and the resources that you access. Such information may include traffic data, location data and other communication data.
- Information provided voluntarily by you like name, e-mail address, mailing address, phone number, health record, insurance information, healthcare contacts, vital measurements etc.
- Information that you provide when you communicate with us by any means using the application or during communication with our customer support team.
- Information you provide related to billing to include payment information such as your credit card, debit card or any other payment or billing type information
- Information related to your medical history include prescription refills, diagnostics, lab results or any other medical information you store and maintain using our application
Use of your Information
The information we collect, process, and maintain for you through the use of our application through both web and smartphone may be used in one of the following ways:
- To improve user experience – we may need to use your information to helps us to respond to your support needs and service requests more effectively. This will help us provide a great user experience for you.
- To maintain your information – We will not sell your information regardless of if it is public or private to you. We will also not exchange or allow other companies access to your information that is generated or maintained through our application. We will not use your information in any manner whatsoever without your consent, other than for the expressed purpose of delivering the service requested
- Email address use – The email address you provide will only be used to send you information, respond to inquiries, and/or other requests or questions related to use of our application. We will not sell your email to any third-party companies.
- To customize your experience – Your information helps us to better respond to your individual needs and better use of our application for maintaining your medical history and to inform your health decisions.
- Your payment and billing related information – Your payment details such as your credit card, debit card, bank information etc. will only be used to subscribe to our services per our billing requirements. Your payment information will only be used to renew your subscriptions per your consent.
Your Information Security
Safety of your personal and public information is maintained through implementation of multiple security measures. Your information that we collect, process, and maintain using our application is protected using a secure server. Your payment information is protected by our third-party partners who have security built in to process your payments, this third-party vendor has international standards for recognizing and maintain your payment processing information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Database to be only accessed by those authorized with special access rights to our systems and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) is stored safely in our secure servers in an event you have selected for auto renewal of your monthly or quarterly payments.
Unfortunately, the sending of information via the internet is not totally secure and on occasion such information can be intercepted. We cannot guarantee the security of data that you choose to send us electronically, Sending such information is entirely at your own risk.
Disclosing your Information
We will not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

CareBynd with its sole discretion, may offer third party products or services on through our application both via web and smartphone versions. These external third-party vendors and sites have their independent privacy policies and terms and conditions including independent billing needs for services they offer through their websites or applications. Our attempt is usually to provide one stop shop and hopefully subsidies for using their services if you access their services through CareBynd. When we offer these services through CareBynd usually by providing a link, it does not mean that we endorse or approve that site’s policy towards visitor privacy or other terms and conditions of use. You should review their privacy policy before sending or sharing with them any personal data.
Information Access
In accordance with the Data Protection Act you have the right to access your information that we hold using our application or during any other support related communication with us. Please note that we reserve the right to charge a fee to cover costs incurred to us in providing you with that information.
Compliance to Children’s Online Privacy Protection Act
We make every attempt to follow the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older. It is the account administrator’s responsibility to ensure they provide access to their family and individual medical history using our application to children aged 13 years or older. It is sole responsibility of the parent or legal guardian to protect the use of the application and access to medical history to children above the age of 13 years.

This online privacy policy applies only to information collected through our application either via CareBynd website or smart phone application and not to any information collected offline.

As specified herein, you acknowledge and agree that CareBynd does not provide any medical services nor medical advice and does not make any representations, warranties, guarantees or endorsement regarding any medical services or advice that you may obtain through use of CareBynd application or its website or through use of its services. Always regard professional advice and do not delay in seeking medical services or treatment because of anything you may read or perceive using CareBynd website or services offered through CareBynd by other third-party services or vendors. If you think you have a medical emergency, always call your doctor or your local emergency number immediately. Use of CareBynd services does not create any patient and health care provider relationship between the user and CareBynd. CareBynd is neither responsible nor liable for any medical or non-medical advice, course of treatment, diagnosis, inference, or healthcare decisions made by the users. CareBynd is not a pharmacy nor provides any pharmacy services or advice on prescription medication. Contact your pharmacist or healthcare provider for any advice on your prescription medication. CareBynd will not be liable for services provided through a third-party vendor or website, users will be subjected to terms and conditions of the third-party website and vendors.
User Registration, Member Account and Security Obligations
You will be required to register with CareBynd to use our features, functions, and services. If you register to our services, you agree to provide and maintain accurate and complete information about yourself and additional members using the account. Registration and other information about you will be governed by our privacy policies listed in this document. You must be over 18 years of age to be authorized to register to our services. Our services are currently only available to individuals who are in states in which our services are offered, and you will need to be above 18 years of age to register your account or of the legal age allowed by your state where our services are offered and can be used. Our services are subject to state regulations and may change periodically based on state regulatory requirements.
Users are also responsible for maintaining the confidentiality of your password and account information used to log in and access your medical information. You will bear full accountability for all actions that occur on your account with your account information and password. You agree to notify CareBynd of any unauthorized use or breach of your account immediately. CareBynd will not be responsible for transactions made to or from your account by any party using your account information and password, CareBynd will not be liable for any loss or damage resulting from your failure to comply with this section.
Modification of our Services
CareBynd reserves the right to modify or discontinue any of our services either temporarily or permanently. We will notify all users about the changes to our services with 5 days of the change. You agree to comply with the changes to features, functions or services provided.
General Practices Regarding Storage and Use of Information
You agree and acknowledge that CareBynd applies certain practices that may limit the use of certain services or features including the duraton that the data or other content on our application will be retained. There may also be a limit on the storage space used by each account. CareBynd will offer additional price options for users requiring additional storage to store information on the CareBynd application. You also acknowledge that CareBynd reserves the right to change these general practices and storage limits in its sole discretion with or without notice.
Mobile Services
Our services are offered via smart phone devices, some features and functionality may work differently on the smartphone as compared to the web version of the application. You will be ale to upload, share and capture your information through the use of smartphone application. In addition some services may be limited by your phone’s service provider or smartphone device. You agree to incur all charges that apply to you for use of internet or other phone provider services offered to you through your smart phone service provider, CareBynd is not liable for any cell phone or smart phone charges incurred by your phone or internet service provider. CareBynd may communicate with you through texts or other messaging applications such as Wattsapp, you agree to this format of communication from CareBynd.
Account Terminations
CareBynd in its sole discretion may suspend or terminate your account or discard any content in your account for any reason including without limitation if CareBynd has reasonable reaons to believe that you have violated these terms and conditions. Any suspected fraudent, abusive or illegal activity can warrant termination of the service. In the event CareBynd terminates your account, you will be refunded any charges that are due from the day of termination.
Intellectual Property
You acknowledge and agree that CareBynd services may contain features, content and functionality that may be protected by CareBynd trademark, copyrigh, trade secret or other prorietry rights governed by the laws of state of Texas, United States. You agree to not modify, copy, frame, scrape, rent, lease, loan, sell distribute or create derivative works content, services in part or whole provided by CareBynd except for any data that you own or provide to CareBynd to maintain your services will be regarded as your information that you will have full rights and can request from CareBynd. Technology, resources, software and hardware services provided by CareBynd will be sole property of CareBynd, you agree to not reverse engineer and attempt to discover the source code and sell or lease or sublicense or otherwise transfer any right in the software. Rights are entirely reserved by CareBynd.
CareBynd name, logos, tag line, intellectual property, copyright and trademarks are sole property of CareBynd, nothing in this terms and conditions provides you the right to grant permision or implication to use these properietry rights of CareBynd.
CareBynd will not be liable for any content, materials, information or services provided by third party vendors or websites on behalf of CareBynd to its users. You understand and acknowledge that CareBynd does not pre-screen any third party material or services, you are entirely liable to agree to the terms and conditions of those services by these vendors.
User Content and Personal Information
All the material you upload or gather in the CareBynd application for your health journal maintenance and management either by you or any other individual you have authorized to use your account will be entirely account holder’s (account admin) responsibility. Account admin will represent and warrant that you own all rights, title and interest in any such user content including without limitation all copyrights and rights of pulicly contained. You provide all the user content voluntarily which may include personal information not limited to medical information of all users of the account, you are consenting to use of your personal information including medical information in accordance to these terms and conditions.
You are also consenting CareBynd authorized employees to access and assist you in managing this information, CareBynd authorized employees will only access your information to support your needs to maintain and manage your information. You consent to store this information on CareBynd’s servers for you to acccess at any time through use of web or smart/mobile phone devices.
